APPLICANT REQUESTS THAT:

His DD Form 214, Armed Forces of the United States Report of 
Transfer or Discharge, reflect award of the following:

	1.  Korean Service Medal.

	2.  Air Force Overseas Ribbon.


APPLICANT CONTENDS THAT:

He never received the contested awards.

The applicant’s complete submission, with attachment, is at 
Exhibit A. 


STATEMENT OF FACTS:

The applicant entered the Regular Air Force on 10 August 1956.

On 6 January 1960, the applicant was honorably discharged in the 
grade of airman second class under the provisions of AFR 39-
14 (Convenience of Government).  He served 3 years, 4 months and 
27 days on active duty and credited with 11 months and 26 days 
of foreign and/or service.


AIR FORCE EVALUATION:

AFPC/DPSID recommends denial.  DPSID states there was no 
official military personnel record available for review at the 
time of this request.  The only document available for review 
was the applicant’s DD Form 214, dated from 10 August 1956 to 6 
January 1960.





The Korean Service Medal was awarded for service between 27 June 
1950 and 27 July 1954 under and of the following conditions: 
within the territorial limits of Korea in waters immediately 
adjacent thereto: or with a unit under the operational control 
of the Commander-in-Chief, Far East, other than those units 
within the territorial limits of Korea, which has been 
designated by the Commander-in-Chief, Far East, as having 
directly supported the military efforts in Korea; or was 
furnished an individual certificate by the Commander-in-Chief, 
Far East, testifying to material contribution made in direct 
support of the military efforts in Korea.

There is no official documentation available nor was any 
provided with this request to verify the applicant’s dates of 
service in the area of eligibility for award of the Korean 
Service Medal.  The applicant’s active duty service dates are 
after the award inclusive dates for award of the Korean Service 
Medal; rendering the applicant ineligible for the award.

The Air Force Overseas Ribbon was authorized by the Chief of 
Staff, United States Air Force, on 12 October 1980.  The ribbon 
was authorized to be awarded to Air Force and Air Force Reserve 
members credited with completion of an overseas tour on or after 
1 September 1980.  Only individuals serving on active duty as of 
6 January 1986 are eligible to have the Air Force Overseas 
Ribbon applied retroactively for completion of an overseas tour.

Based on the applicant’s dates of service, they were unable to 
verify award of the Air Force Overseas Ribbon-Long Tour or Air 
Force Overseas Ribbon-Short Tour.  The applicant separated 
active duty on 6 January 1960, several years before the Air 
Force Overseas Ribbon was authorized, rendering the applicant 
ineligible for the award.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

On 27 October 2014, a copy of the evaluation was forwarded to 
the applicant for review and response within 30 days (Exhibit 
D).  As of this date, no response has been received by this 
office. 


FINDINGS AND CONCLUSIONS OF THE BOARD:

After careful consideration of applicant’s request and the 
available evidence of record, we find the application untimely.  
The applicant did not file within three years after the alleged 
error or injustice was discovered as required by Title 10, 
United States Code, Section 1552 and Air Force Instruction 36-
2603.  The applicant has not shown a plausible reason for the 
delay in filing, and we are not persuaded that the record raises 
issues of error or injustice which require resolution on the 
merits.  Thus, we cannot conclude it would be in the interest of 
justice to excuse the applicant’s failure to file in a timely 
manner.  


THE BOARD DETERMINES THAT:

The application was not timely filed and it would not be in the 
interest of justice to waive the untimeliness.  It is the 
decision of the Board, therefore, to reject the application as 
untimely.
